Dear Jade Beach Owner's
In 2022, Jade Beach Villas Association, Inc. (hereafter “Association”) passed and recorded an amended and restated Declaration of Condominium (hereinafter the “Declaration”). Although enough owners voted in favor of the Declaration, a group of owners were not in favor of the revised language and the dispute led to a lawsuit.
Fortunately, the two parties have agreed on language clarifying the intent of the Declaration. In order to adopt this new language and thus resolve the lawsuit, we require a simple majority of at least 32 of our 62 units to vote in favor of this revised document.
In the end, the Declaration and this revised version of the Declaration, were intended only to have the Association’s organizational documents match the operation of the Association for the past several decades.
The changes between these two documents are as follows:
Please use the attached ballot to vote to approve this revised document so that we may settle the outstanding lawsuit. Failure to do so will result in further legal fees that don’t benefit any of our owners. A copy of the marked-up (redlined) version and the final (clean) version of the Declaration are on the JBE and JBW websites for your review.
Instructions to view the Declarations. Open the Oxygen website for JBE/JBW. Click on “Community Information”, click on “Documents”, Click on “Community Information”, click on “JBVA – Documents for Association Vote”, both documents are available to click on and review.

- The description of East Land and West Land was eliminated.
- Jade Beach Villas Association was added when appropriate for clarification
- Expanded and clarified the Improvements on the property
- Limited Common Expense was further defined
- The term of “primarily for the use of” replaced “exclusive use” for the pools
- Location was defined as East of A1A or West of A1A
- Insurance was specified as “for the benefit of” for clarification
- Access for JBW is defined as through the “South Gate”
- Common Room at JBW is available for use with “Notification
